Terms and Conditions of Use

The Azores Biodiversity Portal, hereinafter referred to as ABP, is an electronic infrastructure designed to store, organize, and disseminate data on the region’s biodiversity and ecosystems, contributing to the protection and conservation of nature and environmental sustainability.

The ABP website, https://azoresbioportal.uac.pt/, aims to provide detailed information on the areas in which it operates, including up-to-date scientific knowledge and specialized resources.

The website domain belongs to the University of the Azores, which is the legal entity that represents and is responsible for the ABP. By using the ABP website and the content available on and through it, you are agreeing to the Terms of Use set forth herein.

The User Terms set forth herein may be amended at any time without notice, so it is recommended that the user checks them whenever he visits the ABP website.

Rights of access, opposition, rectification and cancellation

The ABP provides information on its portal free of charge to all citizens and entities, public or private. However, ABP cannot guarantee a total absence of errors or omissions arising from the use of third-party data (for example, publications) for which it does not have complete quality control, which it is ready to correct as soon as it is alerted to it. Every effort has been made to obtain the necessary permissions and ensure the recognition and attribution of authorship to these sources. ABP reserves the right to make, at any time and without prior notice, modifications and updates to the information contained on its website or in its configuration or presentation. ABP reserves the right to temporarily suspend or interrupt the normal functioning of the website for any technical, administrative or force majeure reasons and is not responsible for any loss or damage, direct or indirect, resulting from misuse or deficient interpretation of the information provided.

Unless stated otherwise, the information contained on the ABP website can be used for personal or public use, provided that it is not intended to be offensive, and all interested parties are required to expressly and prominently identify ABP as source (under Creative Commons Attribution 4.0 International – CC BY 4.0).

Content accessed through the ABP website may still be subject to specific terms and conditions imposed by the data provider. In some cases, restrictions on the use of data may be greater, requiring prior authorization for the reproduction or use of textual, numerical, or multimedia data (sounds, images, etc.). The PBA website provides links to pages of other entities, considered to be of interest to the user. However, and despite carefully selecting these links, ABP is not responsible for the timeliness, quality or veracity of the information made available on these sites, nor for any direct or indirect losses or damages resulting therefrom.

Sui Generis Database rights

The ABP is protected under the Directive 2019/790 of the European Parliament and of the Council of 17 April 2019 on copyright and related rights in the Digital Single Market and amending Directives 96/9/EC and 2001/29/EC, even if the contents contained therein are not protected by Copyright. In this way, ABP reserves the right to request prior authorization to extract or (re)use the entirety of a significant part of its contents or non-substantial parts in a systematic way.

The misuse, or unauthorized use, of information or data contained on the ABP website, as well as the consequent damages caused to intellectual property rights, will give rise to the exercise of the corresponding legal actions and, if applicable, of the responsibilities arising from this exercise.

Attempts to change or upload information on this portal, or any other action that may cause damage or jeopardize the integrity of the system, are strictly prohibited, and will be punished in accordance with current legislation.

The use the information contained on the ABP website is the sole responsibility of the user. ABP is not responsible for any consequences, damages or losses that may arise from the aforementioned use of information, with the exception of all actions that result from the applicable legal provisions.

Disclaimer in the context of social websites

The ABP sees the participation of its members in social networks as a way of promoting interactions between the ABP and the community with which it shares interests. However, ABP is not responsible for the contents placed there, which are the exclusive responsibility of its publishers.
